未中標理由：根據招標文件第一章第4.2款的規定：“投標人不應存在利益沖突，發現存在利益沖突的任何投標人均不合格......”和招標文件第二章 ITB 4.2的規定：“2）......其中本合同包的潛在投標人若與本項目第1包總體方案設計包（除大遺址）的中標人（包括聯合體牽頭方和成員方）直接或間接的共同處于他人控制之下，則被視為利益沖突。”（詳見補遺（三）），評標委員會經討論后一致認為，該投標人與本項目第1包總體方案設計包（除大遺址）中標人之間存在利益沖突，不能滿足招標文件第三章 評標和資格標準“2.資格要求”1.合格性中的“1.2 利益沖突”的要求，因此不能通過資格審查。并根據招標文件第二章ITB14.1&14.2規定：“投標人應滿足第三章的資格要求。在對技術投標文件和投標報價進行評審之前，應當先對投標人資格進行評審。不滿足“第三章評標和資格標準”的投標人其投標將被拒絕。”。綜上，該投標人未能通過資格審查，投標被拒絕。

Reasons for why not selected: As specified in 4.2 in Section I of the bidding documents, “A Bidder shall not have a conflict of interest. Any Bidder found to have a conflict of interest shall be disqualified......”. As specified in ITB 4.2 in Section II of the bidding documents, “2) ......If a potential bidder of Lot 05 and the successful bidder (including the leading party and any member party of the JV) of Lot 01: Global programming for the whole project (except archaeological sites programming) of this Project are directly or indirectly under the control of a third party, it will be considered as a conflict of interest” (see Addendum (III)). Through discussion, the bid evaluation committee concluded that the Bidder has a conflict of interest with the successful bidder of Lot 01: Global programming for the whole project (except archaeological sites programming) of this Project. Therefore, the Bidder can not meet the requirements of “1.2 Conflict of Interest” in “1. Eligibility” in “2. Qualification Requirements” in Section III - Evaluation and Qualification Criteria and thus fail to pass the qualification examination. And according to ITB 14.1&14.2 in Section II of the bidding documents, “Bidders shall meet qualification requirements specified in “Section III - Evaluation and Qualification Criteria”. Bidder’s qualification shall be evaluated before evaluation of the technical part of bid and the bid price. Bids which are not compliant with the requirements of Section III shall be rejected.” Based on the above mentioned, the Bidder failed to pass the qualification examination and its bid is rejected.
